Welcome to NL Tradepost. These Terms of Use govern your access to our website and services. By creating an account, posting a job, contacting a contractor, or otherwise using the platform, you agree to these terms and our Privacy Policy.
Contractors who pay for membership also agree to our separate Contractor Membership Terms.
1. What NL Tradepost is
NL Tradepost is an online marketplace that helps homeowners and property owners in Newfoundland and Labrador find contractors and post jobs. We provide listings, profiles, and tools to connect users.
We are not a contractor, employer, agent, or guarantor. We do not perform construction work, supervise projects, or employ the contractors listed on the platform. Any agreement for work is directly between the homeowner and the contractor.
2. Eligibility and accounts
You must be at least 18 years old and able to enter a binding contract to create an account. You agree to provide accurate information and keep your login credentials secure.
You are responsible for activity under your account. Notify us promptly if you suspect unauthorized access.
We may suspend or terminate accounts that violate these terms or that we reasonably believe pose a risk to users or the platform.
3. Homeowners and job posters
Posting a job and browsing contractors is free for homeowners unless we state otherwise on the site.
When you post a job or contact a contractor, you agree to:
- Provide truthful information about the work you need.
- Use the platform respectfully and for legitimate residential or property-related purposes.
- Perform your own due diligence before hiring, including verifying licences, insurance, references, and written quotes. See our Safety page.
- Not use the platform to harass, spam, or solicit unrelated services.
We do not guarantee that any contractor will respond, be available, or complete work to your satisfaction.
4. Contractors and listings
Contractors may create a business profile and, where applicable, purchase an annual membership as described on our membership page and in the Contractor Membership Terms.
Contractors are solely responsible for the content of their profiles, including business name, trade, credentials, photos, pricing statements, and contact details. Listings are self-reported unless we explicitly mark a field as verified.
We may edit, hide, or remove listings that appear inaccurate, misleading, incomplete, or in violation of these terms or our Safety guidelines.
5. User content and licence
You retain ownership of content you submit (profile text, photos, job descriptions, messages). You grant NL Tradepost a non-exclusive, royalty-free licence to host, display, reproduce, and distribute that content on the platform and in related marketing for the purpose of operating and promoting the service.
You represent that you have the rights to any content you upload and that it does not infringe third-party rights or violate law.
6. Prohibited conduct
You may not:
- Post false, defamatory, or fraudulent content.
- Impersonate another person or business.
- Scrape, crawl, or reverse engineer the platform except as allowed by law.
- Introduce malware or attempt to disrupt our systems.
- Use the platform for unlawful discrimination, harassment, or hate speech.
- Circumvent access controls or access data you are not authorized to view.
7. Payments
Homeowner features are free unless stated otherwise. Contractor membership fees, billing, refunds, and renewal are governed by the Contractor Membership Terms.
Third-party payment processing is provided by Stripe. Their terms apply to payment transactions.
8. Disclaimers
The platform is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the site will be uninterrupted, error-free, or free of harmful components. We do not verify every credential, licence, or insurance policy listed by contractors.
9. Limitation of liability
To the fullest extent permitted by law, NL Tradepost and its operators are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill arising from your use of the platform or any transaction between users.
Our total liability for any claim related to the platform is limited to the greater of (a) $100 CAD or (b) the amount you paid us in the twelve months before the claim, except where such limitation is prohibited by law.
Nothing in these terms excludes liability that cannot be excluded under applicable law, including certain consumer protection rights.
10. Indemnity
You agree to indemnify and hold harmless NL Tradepost from claims, damages, and expenses (including reasonable legal fees) arising from your use of the platform, your content, your interactions with other users, or your violation of these terms or applicable law.
11. Third-party links and services
Contractor profiles may link to external websites. We are not responsible for third-party sites or services. Your use of Stripe and other integrations is subject to their respective terms and privacy policies.
12. Changes
We may update these Terms of Use from time to time. We will post the revised version with a new “Last updated” date. Continued use after changes means you accept the updated terms, except where further consent is required by law.
13. Governing law
These terms are governed by the laws of the Province of Newfoundland and Labrador and the federal laws of Canada applicable therein.
